Terms of Service – Sammy’s Boutique

1) Access & Account
Summary: You must be of legal age and keep your account secure.
By using our website sammysboutique.net (the “Site”) and services (the “Services”), you confirm you are at least 18 (or legal age in your country). You’re responsible for your account, passwords, and all activity. We may suspend or refuse service for policy violations or misuse.
2) Our Services & Third-Party Fulfillment
Summary: We design/sell products and use a trusted print-on-demand partner to make and ship them.
We sell white-label products fulfilled by a third-party manufacturer/shipper (our “Fulfillment Partner”). Your contract for purchase is with Sammy’s Boutique; production, packing, and delivery are performed by the Fulfillment Partner on our behalf.
3) Modifications
Summary: Policies and prices may change.
We may update these Terms, features, or fees. Changes take effect when posted. If you disagree, stop using the Services.
4) Content & IP
Summary: You must have rights to what you upload; we respect others’ IP.
Content you submit (e.g., text, images, reviews) must not infringe third-party rights. You grant us a non-exclusive license to use your content to operate and promote the Services. We may remove unlawful or infringing content.
5) Acceptable Use
Summary: Don’t break laws, harm our systems, or misuse our brand.
No fraud, harassment, malware, or rights violations. Don’t misuse our trademarks or branding.
6) Orders, Shipping & Risk of Loss
Summary: Orders move fast; address accuracy matters.
Orders may begin processing immediately and may not be editable after submission. Provide complete, accurate shipping details. Title and risk of loss pass per applicable law when the carrier takes possession. Delivery estimates are not guarantees.
7) Returns, Claims & Exchanges
Summary: Unused/defective/not-as-described items may be returned; buyer’s remorse and size/color changes aren’t accepted.

We accept returns only if unused, defective (manufacturing/shipping), or not as described.

Claims window: “Any claims for misprinted/damaged/defective items must be submitted within 30 days after receipt. For packages lost in transit, claims must be submitted no later than 30 days after the estimated delivery date. Claims deemed our error are covered at our expense. When we receive a returned shipment, an automated email notification will be sent to you. Wrong Address—if you provide an insufficient address, the shipment may be returned; you are liable for reshipment costs after address confirmation. Unclaimed—unclaimed shipments returned to us require reshipment costs. Returned by Customer—we do not refund orders for buyer’s remorse. Size/style/colour exchanges require a new order at your expense and returning the prior order at your expense. If the product is unused and undamaged, a full refund will be granted; used/damaged items are non-refundable. Withdrawal requests are evaluated for use or damage; in such cases, refunds aren’t possible.”

EU notice (Directive 2011/83/EU): No right of withdrawal for custom/personalized goods or sealed goods unsealed after delivery for health/hygiene reasons. We may refuse returns at our discretion.

Return shipping is the customer’s responsibility unless the return results from our error. Original shipping fees are non-refundable.
8) Prices, Payments & Taxes
Summary: You agree to pay listed prices, fees, and applicable taxes.
Charges are shown at checkout. You confirm your payment method is authorized. Taxes and duties may apply per destination rules.
9) Warranties & Disclaimer
Summary: We provide Services “as is”; color/size visuals may vary.
Except as required by law, we disclaim implied warranties. Product photos are illustrative; minor color/size variances can occur.
10) Liability
Summary: Our liability is limited.
To the extent permitted by law, we’re not liable for indirect or consequential losses. Direct liability is limited to the amount you paid for the affected order.
11) Consumers in the EEA/UK
Summary: You keep your mandatory consumer rights.
If you’re an EEA/UK consumer, your statutory rights (e.g., remedies for lack of conformity) apply and aren’t limited by these Terms.
12) Governing Law & Dispute Resolution
Summary: Norwegian law applies; courts of Norway have jurisdiction (your mandatory local rights remain).
These Terms are governed by Norwegian law. Disputes shall be resolved by the courts of Norway, without prejudice to mandatory consumer protections in your country of residence. You may also use the EU ODR platform or your local consumer authority where applicable.
